New Delhi: The Delhi High Court has said that under the provisions of the Penal Procedure Code, those who provide maintenance to the spouse do not have a comprehensive liability for all times, i.e. a fixed amount is no longer required and can be increased or decreased if the spouse’s circumstances change. Justice Chandradhari Singh said the court made the remarks while deciding on a review petition filed by a woman seeking an increase in the amount of alimony to be paid by the husband as per the lower court order. Monthly Rs. 5000 alimony and said that the lower court has ordered Rs. An amount of Rs 5,000 was fixed which is not enough to support him. The woman argued that her husband’s monthly income was Rs. 5,000 and he has not given his actual income to the lower court. Defendant’s husband claimed that he lived in a rented house and worked as a cab driver for Rs. He is earning Rs 15,000 and has to take care of his elderly and sick parents.
