Adult women should not be harassed by police while engaging in sex work: Supreme Court

A three-judge bench of the apex court has ruled that prostitutes or sex workers also run a business and should enjoy the same basic rights as other persons under Article 21 of the Constitution. In addition, on the recommendation of a court-appointed committee on sex workers, the court directed the state and central governments that adult women should not be harassed by the police while engaging in sex work. The court also directed the media not to publish pictures of women in such cases if the police conduct raids. The Supreme Court in its order said that every sex worker must be treated humanely by the police. If the picture of the woman caught during the raid is published then legal action will be taken against the media. The court had constituted a committee in 2011 during the hearing of a case which submitted its final report to the Supreme Court. The report covers three important issues. 1. To prevent human trafficking for sex work. 2. To give proper support to those who want to quit prostitution. 3. To create a conducive environment for those who want to be involved in prostitution and to do humane business. The Central Government has objected to some of the recommendations of the committee and further hearing of the case will be held on. It will run after the central government submits its reply on July 8. In the meantime, the details of the recommendations that have been challenged are as follows.
1. Sex workers should also be allowed to do humane business in accordance with the article of the constitution. Crimes should be registered only if the age and age of the offense has been committed. If the sex worker is an adult and voluntarily engages in the act, he should not be charged.
. No crime should be reported against a sex worker during a raid on a fireplace. Consensual sex is not illegal in the country but it is illegal to explode.
. Only the mother is a sex worker so no child should be separated from the sex worker
. The state governments and the central government should formulate a policy considering the sex workers’ sex prostitution laws, facilities and other requirements.
. If a sex worker is sexually harassed, he or she should be provided with all the facilities available to the victim of sexual harassment, including immediate medical attention under the law.
